Brecher was able to prove that the child's mother was inappropriately discharged from the hospital late in her pregnancy, even though she exhibited signs of pre-eclampsia as indicated by her elevated blood pressure, protein in her urine and complaints of headaches. Several days after the mother was discharged, she presented to a local hospital where she suffered a placental abruption which resulted in the death of her child. A placental abruption is a known consequence of untreated pre-eclampsia.
