Partner Steven Wigrizer Reaches Settlement in Medical Malpractice Case
Steven G. Wigrizer, a partner with Wapner, Newman, Wigrizer & Brecher, has reached a confidential settlement in a case involving the death of a 63-year-old woman. The woman was admitted to the hospital for a bleeding ulcer. In an effort to protect her airways, she was intubated. When she was ultimately extubated, she experienced respiratory distress, at which time she was reintubated by a CRNA and a student nurse. Unfortunately, the intubation was not performed properly, as the woman's esophagus, or food pipe, was intubated as opposed to her trachea, or windpipe. This caused the woman to go into cardiovascular collapse from which she never recovered. The case was settled following jury selection and opening statements.

$2 Million Settlement for Tractor Trailer Accident that Killed Two
Steven Wigrizer, a partner with Wapner, Newman, Wigrizer & Brecher, settled a motor vehicle case that killed two people. The accident occurred when a tractor trailer crossed a medial divider and struck and killed Mr. Wigrizer's clients. Both individuals died instantaneously in the crash, but Mr. Wigrizer was able to prove that the accident resulted from a display of aggressive and erratic driving entirely consistent with a psychiatric crisis which the defendant's employer should have known about. It was Mr. Wigrizer's position that the driver should have never been permitted to operate a truck, and that if the trucking company had acted with due diligence, then the accident could have been avoided.
$8 Million Settlement for Neurological Injury to a Young Child
Steven Wigrizer, a partner with Wapner, Newman, Wigrizer & Brecher, settled a case for $8 million for a young child with neurological injuries. The case concerned the severe neurological impairment of a young child due to dehydration. The case involved allegations of negligence against a childcare nurse, several pediatricians and the emergency room at a local hospital. It was plaintiff's position that proper care involving hydration, including the simple act of placing a standard intravenous line, would have prevented the child from suffering any harm. As a result of the defendants' negligence, the child became severely dehydrated and ultimately suffered a devastating neurological injury.
$7.6 Million Settlement for Misdiagnosed Bacterial Meningitis
Steven Wigrizer, a partner with Wapner, Newman, Wigrizer & Brecher, settled a medical malpractice case for $7.6 million. The case concerned a normal child who was presented to the hospital neurologically intact. Although the child's signs and symptoms upon his arrival at the hospital suggested bacterial meningitis, hospital personnel failed to perform the appropriate tests. Had the proper tests and treatment been carried out and the appropriate diagnosis made, the child's bacterial meningitis could have been effectively treated, preventing catastrophic injuries. As a result of the failure to diagnose, the child now suffers severe neurological injuries.
$3 Million Settlement for Inappropriate Use of Heparin
Steven Wigrizer, a partner with Wapner, Newman, Wigrizer & Brecher, settled a medical malpractice case involving the death of a 53-year-old man who spent the last three years of his life in a persistent semi-conscious state because of the inappropriate use of Heparin, an anticoagulant medication which the defendants used to treat mild intracranial bleeding. Three years later, Mr. Wigrizer's client died from complications stemming from his neurological impairment.

Steven Wigrizer, a partner with Wapner, Newman, Wigrizer & Brecher, settled a medical malpractice case involving the death of a 39-year-old mother of five in which the defendants failed to properly diagnose a malignant melanoma. The defendants' negligence resulted in a three-year delay in diagnosis, thereby allowing the cancer to progress from a curable stage to an incurable one.
$5.6 Million Medical Malpractice Settlement for a 6-Year-Old Made Blind
Steven Wigrizer, a partner with Wapner, Newman, Wigrizer & Brecher, settled a medical malpractice claim involving a six-year-old boy who was rendered permanently blind due to defendants' failure to perform timely serial eye reexaminations for retinopathy of prematurity, or ROP. Mr. Wigrizer was able to prove that had these re-examinations been carried out, the serious and progressive nature of the child's ROP would certainly have been identified and prompt surgical intervention would have halted the retinopathy's progression and preserved the child's vision.
$5.4 Million Settlement for Family of Burn Fatality
Steven Wigrizer, a partner with the law firm of Wapner, Newman, Wigrizer & Brecher, settled a motor vehicle collision on behalf of a married, 36-year-old owner of an excavating company who tragically died 92 days after sustaining second and third degree burns over 61 percent of his body and severe smoke inhalation injuries as a result of a motor vehicle accident. The man was stopped and waiting to make a left-hand turn when he was struck in the rear by a six-wheel box truck. The collision caused the vehicle to burst into flames, causing severe burn injuries. Mr. Wigrizer's client was survived by his wife of twelve years and their three children.
