Settlement Obtained on behalf of the Estate of Stillborn Child
Philadelphia and Allentown, Pennsylvania, New Jersey
Managing Partner Marc Brecher of Wapner, Newman, Wigrizer, Brecher & Miller has obtained a substantial settlement on behalf of the estate of a child who was stillborn. Brecher was able to demonstrate that during labor, the mother exhibited signs and symptoms of placental abruption. During a placental abruption, the placenta separates from the uterus, leaving both mother and baby in serious jeopardy. In this case, the mother had severe abdominal pain which was ignored by the medical staff attending to her during labor. But the time medical staff recognized that the baby's heart rate was lost, it was too late to save the child. In addition to the substantial settlement award on behalf of the estate of the deceased child, the mother also received compensation for her own bodily injury and emotional distress claim.
