Attorney Erik Vogel Wins $300,000 for Client in Dental Malpractice Case

Attorney Erik Vogel, a partner at Wapner, Newman, Wigrizer & Brecher, won $300,000 for his client in a dental malpractice case. The client suffered a nerve injury in the left side of his jaw after an unsuccessful procedure to grow bone for future dental implants. Attorney Vogel was able to obtain $300,000 for his client for his injuries.

 



Attorney Erik Vogel Wins $150,000 for Client for Slip & Fall


Attorney Erik Vogel, a partner at Wapner, Newman, Wigrizer & Brecher, won $150,000 for his client in a slip and fall incident. The client broke her leg after slipping and falling on a patch of ice. This win is the latest in a series of victories for Attorney Vogel on behalf of his clients. 

 



$440,000 Settlement for Failure to Diagnose

Erik Vogel, a partner at Wapner, Newman, Wigrizer & Brecher, settled a failure to diagnose testicular torsion case for $440,000. Mr. Vogel's client felt a popping sensation and pain in his groin area while lifting boxes at work. The client went to his family doctor later that day and the physician incorrectly diagnosed the client with epididymitis, which is essentially an inflammation in the scrotum. The defendant failed to consider or rule out testicular torsion, which is a medical emergency. Testicular torsion occurs when the cord attached to the testicle becomes twisted and cuts off blood flow to the testicle. If the torsion is not addressed quickly, the testicle may die due to lack of blood flow. The defendant physician failed to order any relevant tests and failed to refer the client to a nearby emergency room. Instead, the defendant doctor prescribed an anti-inflammatory and warm baths, and instructed the client to go home and rest, and return in 2 to 4 days if his condition did not improve. After experiencing severe groin pain for 2 days, the client went to an emergency room where an ultrasound revealed testicular torsion. Given the 2-day delay, however, the testicle had died and was removed during surgery. The $440,000 settlement was for pain and suffering.

 



Attorney Erik Vogel Wins $200,000 Medical Malpractice Trial

 

Attorney Erik Vogel, a partner at Wapner, Newman, Wigrizer & Brecher, tried a medical malpractice case at an arbitration based on an alleged failure to timely diagnose Vitamin B12 deficiency and his client received $200,000. The delay in diagnosing he vitamin deficiency resulted in nerve damage.

 



$150,000 Settlement for Woman Hit by Truck

 

Attorney Erik Vogel, a partner at Wapner, Newman, Wigrizer & Brecher settled a case for $150,000 involving a woman who was knocked off her bicycle by a passing truck. The client sustained injuries to her hip and shoulder, and eventually made a good recovery. The settlement was for pain and suffering only.

Pain and Suffering Damages Secured in a Case of Medical Negligence

 

In a confidential settlement, attorney Erik K. Vogel secured pain and suffering damages in the amount of $450,000 in a medical negligence case in New Jersey.  During a common intestinal obstruction surgery, the surgeons failed to identify and protect the victim’s kidney ducts, causing them to be nicked during surgery.  The surgeons then failed to recognize the injury in a timely manner.  Such negligence led to the temporary use of nephrostomy tubes and the eventual removal of one of the victim’s kidneys.

Damages for pain and suffering were sought from the surgeons of record and the hospital, who agreed to settle.  Thankfully, the victim has fully recovered from the injuries and kidney removal and is now living a normal life. 

 

Student Run Over by Runaway Bus Settles His Underinsured Claim

2007

Erik K. Vogel of Wapner, Newman, Wigrizer & Brecher has obtained the entire amount of an underinsured motorist policy on behalf of a minor student who was hit by a Pennsbury School District school bus in January of 2007. This incident was a well-publicized event which involved several high school students being struck by a runaway school bus. The parents of the minor maintained an automobile insurance policy with underinsured benefits. Mr. Vogel was able to get the insurance company to offer the entire amount of the underinsured coverage. Mr. Vogel is also pursuing additional claims on behalf of his client against the responsible parties.

 



Suit Filed On Behalf of Couple Injured in Slip & Fall Accident

2007

Erik K. Vogel, an attorney with Wapner, Newman, Wigrizer & Brecher, has filed suit on behalf of a woman and her husband against a prominent hotel chain as a result of a slip and fall incident. While walking down South Broad Street in Philadelphia, Mr. Vogel's client slipped and fell on an isolated patch of ice outside the hotel, resulting in a fractured femur. The most recent snowfall occurred a couple of days before the incident, and most of the area had been cleared of ice and snow. However, there remained a small, isolated patch of ice and snow on the hotel's property, which should have been cleared, resulting in a dangerous condition. Mr. Vogel's client slipped and fell on this patch and essentially had her femur (thigh bone) crack in half. Mr. Vogel's client underwent surgery which included the insertion of a long rod and screws. 

 



Settlement Achieved in Medical Malpractice Suit

2007

Erik K. Vogel, an attorney with Wapner, Newman, Wigrizer & Brecher, has entered into a settlement on behalf of a minor against a surgical center and surgeon for a negligently performed operation on the wrong knee. The minor was supposed to have surgery performed on one knee. However, the surgical team marked the wrong knee and set up the operating room so as to present the wrong knee for surgery. The surgeon proceeded to perform the operation and, after completion, realized the mistake. The surgeon then proceeded to operate on the correct knee. The minor made a good recovery.

 



Attorney Vogel to Represent Cyclist Hit by Trash Truck

2007

Erik K. Vogel of Wapner, Newman, Wigrizer & Brecher has filed suit on behalf of a woman who was hit by an Allied Waste trash truck while riding her bicycle in the Bike/Bus lane on Chestnut Street in Philadelphia. The truck attempted to go around another vehicle which was parked and, in doing so, crossed into the Bike/Bus lane in which Mr. Vogel's client was traveling. Mr. Vogel's client was thrown from her bike and sustained various injuries.

 



Partner Erik Vogel Represents Philadelphia Slip & Fall Victim

2007

Erik K. Vogel of Wapner, Newman, Wigrizer & Brecher has filed suit in Philadelphia against Central Parking System and an apartment complex which leases a parking facility to Central Parking as a result of a slip and fall incident which occurred in January of 2006. Employees of the defendants apparently hosed down an area around the entrance to the parking facility and allowed the water to freeze, creating an icy condition. Mr. Vogel's client slipped and fell on this icy condition when exiting the parking facility, resulting in back and arm injuries and the need for medical care. The suit alleges that the defendants improperly applied water to the ground during the cold January temperatures, allowed the water to freeze resulting in an icy condition, failed to salt or otherwise treat the condition, and failed to warn anyone about the dangerous condition.  

 



Attorney Vogel Wins $1.6 Million Settlement

2003

Erik K. Vogel of Wapner, Newman, Wigrizer & Brecher won a settlement of $1,625,000 for the family of a man who suffered severe injuries and later died after being pinned to a wall by a faulty car display ramp. While watching employees of a local car dealership move a vehicle onto a display ramp, the man was pinned to a wall by the ramp when the car pushed the ramp backwards. The ramp severely crushed the man's chest and abdomen. After being taken to a hospital, the man was treated by a surgeon who neglected to perform the duties necessary to save the man's life. Attorney Vogel reached settlements with the ramp manufacturer, the owner of the used car dealership and the hospital.
