$2,000,000 Settlement for Child who Suffered Severe Brachial Plexus Injury at Delivery
Philadelphia and Allentown, Pennsylvania, New Jersey
Managing Partner Marc Brecher of Wapner, Newman, Wigrizer, Brecher & Miller has obtained a $2,000,000 settlement on behalf of a child who suffered a severe brachial plexus injury at the time of his delivery. Evidence was obtained by Mr. Brecher during the pendency of this action which indicated that the obstetrical intern who delivered this child had virtually no experience in managing a complicated delivery. This delivery was complicated because the mother experienced a condition known as shoulder dystocia in which the baby's shoulder becomes trapped behind her pubic symphysis in the birth canal. Due to the intern's inexperience, Brecher was able to prove that the intern exerted inappropriate excessive force on the baby's head and neck, causing the baby's brachial plexus nerves to tear. As a result of the brachial plexus injury, this child has virtually no use of his arm, wrist or hand.
